1. Acceptance of Terms

By creating an account, uploading music, or booking a video production service with PahariRootsFilms ("we," "us," or "our"), you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Music Distribution Services

2.1 Rights and Ownership

When you distribute music through PahariRootsFilms, you retain 100% ownership of your copyrights. We do not claim any ownership over your sound recordings, musical compositions, or artwork. We act strictly as a digital distributor to platforms like Spotify, Apple Music, and YouTube.

2.2 Royalties and Payouts

Users on our Pro tier keep 100% of the royalties generated from digital stores. Payouts are subject to the reporting schedules of the respective streaming platforms (typically 60-90 days after the end of the month in which streams occurred).

2.3 Prohibited Content

You agree NOT to upload:

• Copyrighted material that you do not own or have a license to distribute (e.g., unauthorized remixes, covers without licenses, sampled beats without clearance).
• Hate speech, discriminatory content, or illegal material.
• Audio containing artificially generated streams (botting or fake streaming manipulation).

Violation of these rules will result in immediate account termination and freezing of royalties.

3. Video Production & Cinematography

3.1 Bookings and Payments

For video production services (including wedding packages, music videos, and line producing), a non-refundable advance payment (booking amount) is required to block dates. The remaining balance must be cleared as per the agreed contract schedule.

3.2 Deliverables and Revisions

Deliverables (teasers, albums, full videos) will be provided within the timeframe mentioned in your specific package. We offer a limited number of revisions (usually 2 rounds) on edited videos. Additional revisions may incur extra charges.

3.3 Equipment and Crew

While we guarantee the use of premium equipment (e.g., Sony FX series, Drones), the exact gear used is at the discretion of the Director of Photography (DOP) based on the location's physical constraints and weather conditions (especially in Himalayan terrains).

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. PahariRootsFilms cannot and will not be liable for any loss or damage arising from your failure to protect your login information. You must be at least 18 years old (or have parental consent) to use our distribution services.

5. Limitation of Liability

PahariRootsFilms shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services, including but not limited to lost profits, lost data, or business interruption, even if we have been advised of the possibility of such damages.

6. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, if we determine that you have violated these Terms of Service. Upon termination of music distribution accounts, we will issue takedown requests to all digital stores.

7. Changes to Terms

We may update these Terms of Service from time to time. We will notify users of any significant changes via email or a notice on our dashboard. Continued use of our services after updates constitutes acceptance of the new terms.
